Fuicelli & Lee has filed a lawsuit against Porter Adventist Hospital for an infection control breach related to spinal and orthopedic surgeries conducted at the hospital between January 2016 and May 31, 2018. Failure to adequately sterilize surgical equipment may have put some patients at added risk for surgical site infections or exposure to hepatitis B, hepatitis C, or HIV.
On April 4, 2018, Porter Adventist mailed letters to potentially affected patients notifying them of the risk. The Colorado Department of Public Health and Environment (CDPHE) became aware of the sterilization breach February 21, 2018, and is continuing to conduct a disease investigation. As of April 4, the CDPHE was not aware of any patient infections, and released this statement: “The risk of surgical site infection related to this event (above the usual risk related to surgery) is unknown. The risk of getting HIV, hepatitis B or hepatitis C because of this issue is considered very low.”
