Defective Cribs

Consumer liability law is a branch of law that related to the legal obligation that manufacturers have to design and manufacture products that are fundamentally safe. Obviously, many products may be unsafe if used improperly, but consumers who use products in the way that they were intended, and exercise reasonable caution, should be able to use these products safely. One consumer product that comes up in liability issues relatively often is the baby crib. We would all like to think that when we put the little one down to sleep at night, he or she will be safe in the crib but unfortunately this is not always the case. Thousands of children are injured in accidents involving cribs and mattresses every year in the United States. In 2009, there were nearly 15,000 children who were injured at a time when we would hope that they are at their very safest.

New cribs are generally tested for safety and durability before they go into production, so that design flaws can be discovered safely, but some defects miss the safety testing. In some cases, a defect in a crib is only discovered when someone’s child is seriously injured because of it. When a crib manufacturer discovers a potentially hazardous defect in a crib that is already on the market, they issue a recall. As a parent, check with the Consumer Product Safety Commission to see if your child’s crib has been recalled. If you see an item that you own on the recall list, there will be instructions letting you know what you should do about it. If your baby has been injured by a defective crib, consult with a Denver product liability attorney right away to discuss your options.

Product liability is a specialized area of law, and when it comes to protecting the safety of your child, experience matters. You need an attorney who has worked with the complicated issues that a product liability case entails, in order to get the best possible outcome for your child. And you may want to keep in mind that if your child has been injured by a defect in the design, manufacture or labeling of a crib, by taking action against the manufacturer you may even be protecting other people’s children from similar suffering.

The attorneys at Fuicelli and Lee, PC are compassionate, experienced Denver product liability lawyers who can protect your legal rights, and help prevent other children from being injured by the same product in the future.
