Dangerous Toys

Many parents will tell you that nothing makes them feel more at peace than watching their children happily at play in the home. While everyone is aware that some toys can be unsafe, there tends to be an expectation that the toys we buy for our children will be safe. During 2010, the Consumer Products Safety Commission (CPSC) reported recalls of 30 different children’s toys for reasons ranging from being small enough to choke on to lead exposure to risks of various other injuries as well. Toy manufacturers who discover a design or manufacturing defect are required to report their discoveries to the CPSC immediately. If they fail to do so, they may be further negligent for failing to warn consumers of potential hazards.

There are numerous possible causes of recalls of children’s toys, including but certainly not limited to:

  • Some small toys may be small enough to fit in the mouth but too large to be swallowed, creating a choking hazard.
  • Toys that may be easily broken leaving sharp edges may be recalled for laceration hazards.
  • Some toys are found to contain lead or other poisonous substances.
  • Toys that have strings or cords may, if defective, present a strangulation hazard.

Again, no parent expects that the toys they give to their children will cause injuries, but the sad fact is that it does happen quite often. As a parent, one way that you can protect your children is by checking periodically with the CPSC for recalls of your children’s toys. Each recall will include an indication of the danger, as well as what you should do about it. If your child has been injured by a defective toy, speak with a Denver defective product attorney as soon as possible. Something to keep in mind is that by bringing the danger of the toy to the attention of the manufacturer, and making them take responsibility, you may be protecting other children from being hurt in the future.

The experienced defective product attorneys at The Law Firm of Fuicelli and Lee will dedicate themselves to protecting your family, so that the injury that a defective toy has caused your child will not cause undue financial hardship. Your child’s health is too important to take chances, and Fuicelli and Lee, PC can negotiate with insurance companies to ensure the highest quality of care, and take legal action against negligent manufacturers to prevent similar injuries in the future.
