Overloaded Truck Accidents
Denver Accident Attorneys

overloaded truckOverloaded cargo, or cargo that has not been loaded according to state and federal regulations can be dangerous. It can even cause a catastrophic semi-truck accident. The cargo could add so much weight to an already over-sized truck that it causes the truck to be top heavy, increasing the risk of jackknifing or overturning on curves.

Additionally, improperly loaded or overloaded cargo can shift while the truck is in motion. If this happens, objects on the truck can fall off, directly hitting a vehicle, or leaving debris in the road.

Some of the objects that large trucks carry, include appliances, heavy piping, logs, and other vehicles. Small items that fall off of trucks can also be hazardous, causing obstructions in the road. These objects force drivers to abruptly maneuver around them, putting themselves and other motorists in danger. Improperly loaded or overloaded trucks can also cause multi-vehicle crashes, resulting in large-scale injury, death, and property damage. When this happens it is important to contact a Denver accident attorney for help immediately.

Loading Regulations

The Federal Motor Carrier Safety Administration has implemented a number of laws regarding the safe and proper loading of trucks. The intent of these regulations is to minimize the number of accidents caused by shifting cargo or falling debris from commercial vehicles operating in interstate commerce. These regulations mandate:

  • Cargo must be fastened securely on or within a vehicle,
  • Trucks must adhere to minimum tie-down requirements,
  • Cargo that is apt to roll must be restrained by wedges, chocks, or cradles,
  • Vehicles carrying heavy machinery, steel or concrete beams, crane booms, and other objects that require special restraining systems, must meet Special Purpose Vehicle requirements,
  • Trucks carrying logs, metal coils, concrete pipe, heavy vehicles, automobiles, and similar items must meet Commodity-Specific Securement Requirements, and
  • Vehicles transporting loads that extend beyond its width, or that project beyond the rear of the vehicle by more than four inches, must attach colored lights to the load to warn other drivers.

Compensation for Truck Accidents

The consequences of falling debris or a jackknifed truck due to overloading or improperly loading a truck can be life-altering. If a trucking company is negligent in the loading of a large truck which leads to an accident, a personal injury lawyer can pursue compensation to cover resulting losses. Injury victims could receive compensation for:

  • Medical bills,
  • Lost income,
  • Pain and suffering, and
  • Mental anguish.

In some situations, a truck accident attorney can seek punitive damages against negligent companies to ensure they follow regulations in the future.
