Aggressive Driving in Colorado
Denver Aggressive Driving Attorneys

Aggressive driving has a significant impact on traffic accidents on U.S. roadways. It is a factor in not just highly publicized incidents of road rage, but in numerous deadly highway collisions every year. The National Highway Traffic Safety Administration (NHTSA) views aggressive driving as anytime an individual commits a combination of moving traffic violations in such a manner that property or other people are put in jeopardy.  If you’ve been injured due to someone else’s aggressive driving in Colorado, it might be wise to seek competent legal help.

It can sometimes be difficult to quantify aggressive driving, however, a 2009 study by AAA endeavored to identify certain behaviors associated with aggressive driving. Using data tracked by NHTSA’s Fatal Accident Report System (FARS), the Association determined that aggressive driving was a factor in 56{58a8706c238946a1d762cc702cb6ff1bcd8836d454d1022cd52edea2f88316d7} of traffic fatalities between 2003 and 2007- with excessive speed being the most common. Additional contributing factors that fall into this category include:

  • Following improperly or too closely
  • Unpredictable or improper lane changing
  • Driving illegally on the shoulder, ditch, sidewalk, or median
  • Passing in prohibited areas
  • Failing to yield
  • Executing improper turns or failing to signal a turn
  • Recklessly or negligently operating a vehicle or suddenly changing speeds
  • Failing to adhere to warning signs or instructions on vehicles displaying them
  • Exceeding the posted speed limit or safe speed for road conditions
  • Failing to observe traffic signs, traffic control devices, traffic officers
  • Failing to observe safety zone traffic laws
  • Racing
  • Repeatedly flashing headlights

Accidents Caused by Aggressive Drivers

When an aggressive driver disregards the rules of the road and causes an accident that results in property damage, personal injury, or death, they can and should be held accountable.

If you have been injured in an accident caused by an aggressive driver, you have the right to pursue a personal injury lawsuit and seek compensation for your medical bills, automobile damage, lost wages, and other losses.

Avoiding Conflict With Aggressive Drivers

Staying calm and being courteous behind the wheel lowers your risk of an unpleasant encounter with another driver or law enforcement. Aggressive driving repeat offenders could lose their license or serve jail time, they may also be fined or required to take anger management classes.

To avoid conflict, follow the rules of the road which include:

  • Maintaining a safe following distance
  • Using turn signals
  • Allowing others to merge
  • Using high-beams responsibly
  • Tapping your horn when necessary, but no long blasts accompanied by rude hand gestures
  • Be considerate in parking lots

If you encounter an aggressive driver, avoid eye contact and don’t respond with aggression. If you feel threatened, drive to a public place such as a police or fire station or call 911, and if you are confronted, remain in your car, but use your horn to get attention.
